Privacy Policy (GDPR) – CB’s Creations
This Privacy Policy describes how and when CB’s Creations collects, uses, and shares your information when you purchase a product from me, contact me, or otherwise use my services through my website.
Data I Collect
To fulfil your order and to comply with the legal invoicing requirements of the tax authorities, you must provide me with certain information. This includes:
- Your name;
- Your e-mail address (used for the direct delivery of your digital patterns and order confirmations);
- Your address details (Please note: Our website platform, JouwWeb, uses a standardized checkout system that does not technically differentiate between physical and digital products. Therefore, address details are required for every order to generate a valid invoice);
- Payment details and the specifics of the product you ordered.
If you contact me directly (for example, with a question or a custom request), you may also choose to provide me with additional personal information.
Why I Need Your Data and How I Use It
I rely on a number of legal bases to collect, use, and share your information, including:
- Performance of a Contract: As necessary to provide my services, such as when I use your data to process your order, deliver your digital PDF patterns, or provide customer support.
- Legal Obligation: As necessary to comply with a legal obligation, court order, or in connection with a legal claim, such as retaining information about your purchases if required by tax law.
- Legitimate Interests: As necessary for the purpose of my legitimate interests, provided those interests are not overridden by your rights or interests, such as providing, securing, and improving my services and website.
Data Sharing and Disclosure
Information about my customers is important to my business. I only share your personal data for very limited reasons and in specific situations with trusted third parties:
- Service Providers: I engage trusted third parties to perform functions and provide services to my shop (such as my website host JouwWeb and my payment processor). I share your personal data with these third parties, but only to the extent necessary to perform these services.
- Compliance with Laws: I may collect, use, retain, and share your data if I have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce my agreements, terms, and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of my customers or others.
Data Retention (How long I keep your data)
I retain your personal information only for as long as necessary to provide you with my services and as described in my Privacy Policy. However, I may also be required to retain this information to comply with my legal and regulatory obligations. To comply with the statutory administration duties of the Dutch Tax Authorities, I store invoice and order details for 7 years.
Transfer of Personal Data Outside the EU
I may store and process your information through third-party hosting services (such as Google Cloud or specific plug-ins) located in the United States and other jurisdictions. As a result, I may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your own. When I transfer data outside the EU, I rely exclusively on the EU-US Data Privacy Framework or standard contractual clauses approved by the European Commission to ensure your privacy remains fully protected.
Your Rights
If you reside in the EU, you have a number of rights in relation to your personal information under the GDPR:
- Access: You have the right to access and receive a copy of the personal information I hold about you by contacting me using the contact information below.
- Change, Restrict, Delete: You may also have rights to change, restrict my use of, or delete your personal information. Unless there are exceptional circumstances (such as where I am required to store data for legal or tax reasons), I will generally delete your personal information upon request.
- Object: You can object to (i) my processing of some of your information based on my legitimate interests and (ii) receiving marketing messages from me. In such cases, I will delete your personal information unless I have compelling and legitimate grounds to continue using that information or if it is needed for legal reasons.
- Complaints: If you reside in the EU and wish to raise a concern about my use of your information, you have the right to do so with your local data protection authority.
